Plaintiffs Jeana and Brock Giles have lived next door to defendant Elwood Love for approximately 30 years. Plaintiffs' property contains a house, small vineyard, and greenery that separates it from defendant's property. Plaintiffs sued defendant for wrongful injury and cutting of trees.

Contentions

PLAINTIFFS' CONTENTIONS:
Defendant cut and poisoned certain trees on their property. One of the affected trees came close to falling on plaintiffs' home and damaged a vehicle owned by plaintiffs' son.

DEFENDANT'S CONTENTIONS:
Defendant disputed liability.
