Facts

Plaintiff SPPI-Somersville Inc. (SPPI), a developer, sued defendant Chevron as the former owner of property leased to the City of Antioch for use as a sanitary landfill. The property is now owned by SPPI.

Contentions

PLAINTIFF'S CONTENTIONS:
SPPI claimed that Chevron did not disclose the contamination in its sale of the property and also asserted claims under CERCLA and RCRA as well as several common law causes of action.

Damages

SPPI alleged $12 million in damages.

Result

The court granted Chevron's motion for summary judgment on the nondisclosure issue. The remaining claims were settled.
