Facts

Mountain Cascade Inc. sued the City and County of San Francisco, concerning the Public Utilities Commission's construction of the Bay Division Pipeline No. 5 Peninsula Reaches Project.

Mountain Cascade filed a cross-complaint and other lawsuits against other parties involved in the project, all of which are part of the consolidated action.

Contentions

PLAINTIFF'S CONTENTIONS:
The parties allegedly entered into a contract on Dec. 15, 2009 for the construction of the subject pipeline project. A dispute arose between the parties, prompting plaintiff to sue defendant for breach of contract and breach of implied warranty of correctness of project plans and specifications.

DEFENDANT'S CONTENTIONS:
Defendant denied plaintiff's allegations and asserted various affirmative defenses and filed a cross-complaint.

Result

The parties reached a $3.2 million settlement.
