Facts
On October 8, 1994, the plaintiffs, a 30-year-old marketing director and a 26-year-old student, were traveling in a Cessna 172M aircraft, piloted by the defendant on route to Harris Ranch, California. The aircraft encountered a down draft on the final approach, causing it to lose altitude and touch down on a dirt field, short of the runway. The aircraft went through a field, its nose dug into the ground and it flipped over.
Settlement Discussions
The plaintiffs made two separate C.C.P. º998 demands which, combined, totaled $140,000. The defendants offered $8,250. The case was settled at a voluntary settlement conference before Judge Maurice Hogan at JAMS/Endispute.
