On December 12, 1993, the plaintiff, a 26-year-old draftsman, was riding a bicycle northbound on State Route 527 in Bothell, WA. The plaintiff was stopped at a red light at the intersection with 192nd Street waiting to turn left when he was struck by the defendant driver who had been drinking at the defendant restaurant. The defendant driver dragged the plaintiff several hundred yards before stopping. The defendant driver was determined to have a .12 blood alcohol level. The plaintiff brought this action based on negligence theories of recovery.
