In 1992, the plaintiff, Gloria Cruz, a 54-year-old Hispanic human resources assistant, was employed by defendant Hughes Aircraft Company ("Hughes"). During 1992, the plaintiff applied for but did not receive a promotion to a "generalist" position in the human resources department at defendant Hughes. The generalist position was given to a younger, white female. In the following year, the plaintiff was offered and declined a "team member" position in the human resources department. After the plaintiff declined the "team member" position, it was also given to a younger, white female. The plaintiff brought this action against the defendant, Hughes, under age and race discrimination theories of recovery.
