On March 31, 2009, plaintiff Jill Simpson underwent an ileoscopy performed by Dr. Dwaraknath P. Reddy at Casa Colina Surgery Center. During the procedure, Jill sustained a perforation near the abdominal wall of her ileostomy stoma, which required further hospitalization and ongoing medical care.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiffs alleged that Dr. Reddy negligently perforated the abdominal wall during the ileoscopy procedure by failing to use a pediatric ileoscope due to the tight nature of the stomach.
DEFENDANT'S CONTENTIONS:
Dr. Reddy argued that the perforation was a known risk and complication of the procedure particularly in this patient where the stomach had significant inflammation making the tissue more friable, and that he performed the ileoscopy within the standard of care.
Settlement Discussions
Plaintiffs served a CCP offer to compromise on Dr. Reddy in the amount of $29,999 for a total of $59,998.
