On March 12, 2011, at 4 p.m., plaintiff Muriel Metz, 86, was a passenger in a 2003 Jaguar that was traveling east on Clifton Way near its intersection with Elm Drive in Beverly Hills. A 2009 Toyota Corolla driven by defendant Sina Meshkinpour and owned by defendant Nazila Meshkinpour was traveling south on Elm Drive through the intersection with Clifton Way and collided with the vehicle in which Metz was a passenger.
Contentions
PLAINTIFF'S CONTENTIONS:
Metz contended that Sina Meshkinpour was negligent for driving through a stop sign at the intersection of Elm Drive and Clifton Way.
DEFENDANT'S CONTENTIONS:
Sina Meshkinpour denied liability and claimed that the driver of the 2003 Jaguar failed to stop for a stop sign.
Settlement Discussions
Plaintiff demanded $250,000 (policy limits).
Injuries
Metz alleged bilateral rib fractures, abdomen distention, abrasions and trauma, which induced decline in her cognitive abilities. Although Metz had a pre-existing condition that affected her cognitive abilities, she claimed that the accident aggravated that condition. As a result, she alleged she suffered a significant functional decline and has required assistance since the injury. She continued to treat with her neurologist regarding the decline in her cognitive ability.
Result
The case settled for $250,000 (policy limits).
