Center for Biological Diversity, Turtle Island Restoration Network v. National Marine Fisheries Service; United States Department of Commerce; Rebecca Blank, acting Secretary of the United States Department of Commerce
Published: Nov. 10, 2012 | Result Date: Oct. 17, 2012 | Filing Date: Jan. 1, 1900 |Case number: 1:2012-cv-00363 Settlement – Equitable settlement
Facts
Fishermen using long line fishing methods are killing False Killer Whales, a type of dolphin, in Hawaiian waters at unsustainable rates. Mortality in the fishery is contributing to the dramatic decline in the near shore population of the species, which has decreased at a rate of 9 percent each year since 1989 and has been proposed for listing as an endangered species. Conservation groups brought an action against the federal agencies charged with protecting the marine mammals, seeking to implement protections.
Result
Settlement with protections for False Killer Whales to be implemented by Nov. 30, 2012.
