Contentions
PLAINTIFF'S CONTENTIONS:
On October 15, 2002, Peter Zeppeiro obtained a residential mortgage from Homecomings Financial Network. He contended that the servicer of the loan changed several times, ultimately transferring to Green Tree Servicing on February 1, 2013. Shortly thereafter, Zeppeiro applied for a loan modification and asserted that his loss mitigation options were commenced. After Green Tree Servicing foreclosed on his property, Zeppeiro sued Green Tree Servicing, and Northwest Trustee Services alleging wrongful foreclosure in violation of the California Homeowner's Bill of Rights (Cal. Civ. Code Section 2924.11) and California's Unfair Competition Law (Cal. Bus. and Prof. Code Section 17200).
Result
The court granted Green Tree's motion to dismiss with prejudice.
