PLAINTIFF'S CONTENTIONS:
Plaintiff developed, marketed, and sold ultraviolet germicidal solutions for the purposes of improving indoor air quality and energy efficiencies, which included fixtures and bulbs for proprietary UV lamps. Defendant, meanwhile, advertised and soled indoor quality replacement UV cleanser and filtration products, including replacement bulbs for plaintiff's fixtures. Plaintiff alleged that such products infringed on its trademark rights. As such, plaintiff brought this lawsuit against defendant, alleging trademark infringement and unfair competition and false designation of origin.
DEFENDANT'S CONTENTIONS:
Defendant denied plaintiff's allegations and asserted various affirmative defenses.
Result
The parties reached a settlement, in which UV Bulbs agreed to a permanent injunction, permanently enjoining it from infringing on Steril-Aire's trademarks. UV Bulbs also agreed to pay Sterile-Aire $2,000.
