Facts
On August 31, 1988, there had been a remodeling project taking place at the subject shopping center. The Defendants were the general contractor and the subcontractor that poured the stairs. The stair way had been opened to allow pedestrian traffic to get from one side of the shopping center to the other, and the stairway had no handrail.

Defendants contended that the general contractor had offered $40,000; the concrete subcontractor offered $20,000; two other subcontractors made 998 offers of $5,000 and $5,001 respectively; and Plaintiff demanded $125,000.
