Facts

On November 9, 1991, Plaintiff, an 11-year-old student, and her family hosted a birthday party attended by Defendant and family members. The Defendant had left his automobile engine idling while his teenage niece was in the front seat. The automobile was located on the front lawn near the people attending the party, including the Plaintiff. The niece accidentally put the vehicle in reverse and then hit the acceleration instead of the brakes. The vehicle struck the Plaintiff while her father and brother looked on; Plaintiff's mother soon arrived from the back yard to witness her newly injured daughter.
