On Jan. 3, 1997, plaintiff, a 10-year-old boy, had crossed the street to find out whether a trash truck was going to come back around to his house to make a pick-up. As plaintiff was returning to his home across the street, he walked in front of the trash truck, a little more than half way across the street. An uninsured motorist traveling behind the stopped trash truck attempted to pass the truck and struck the plaintiff. The Los Angeles County Sheriff's Department conducted an investigation of the accident and concluded that plaintiff was at fault for not crossing the street within a marked crosswalk.
