Facts

In 1994, plaintiff Kenneth J. Henderson was the Executive Director of the Economic Development Agency of the city of San Bernardino and plaintiff David R. Edgar was the Housing Division Manager of the Economic Development Agency of the city of San Bernardino. Defendants, Sabo & Green, a law firm, and Tim Sabo, a member of Sabo & Green, have served as legal counsel for the Economic Development Agency since prior to 1994. An audit was conducted beginning in September 1994 of Development Department activities, including redevelopment loans. Plaintiffs Henderson and Edgar were placed on administrative leave by the Mayor in September 1994 in connection with the audit. In October 1994, the Mayor terminated Henderson and Edgar's employment. The plaintiffs then brought this wrongful termination action against the defendants.

Special damages for mental and emotional distress, chagrin, worry, anxiety, mortification, shame, grief, damage to reputation and attorney's fees, punitive and exemplary damages to punish or set an example of defendants, Tim Sabo and Sabo & Green.

Other Information

The decision was reached approximately one year after the case was filed. The court found that the evidence showed that neither defendants Tim Sabo or Sabo & Green committed any of the alleged wrongful acts and that no evidence to the contrary had been presented to create a triable issue of material fact.
