Facts
On Aug. 7, 1992, plaintiff Gary Brown, a 51-year-old truck driver employed by Hadley Auto Transport, was loading a Ford F-150 pickup truck onto an auto transport carrier. After loading the truck on the upper tier, the plaintiff attempted to lower himself down to the ground. In doing so, the plaintiff attempted to maneuver around the pickup truck by grabbing the windshield wiper. He fell to the ground. The plaintiff brought this action against the defendant based on negligence and product liability theories of recovery.
