Facts

On Dec. 11, 1996, the plaintiff, a 29-year-old television studio manager, was covering a leaking roof at his employer's request, when the roof suddenly gave way. The plaintiff's feet went through the roof leaving the plaintiff straddling a roof beam, sustaining a back injury. The defendant owned and maintained the subject premises. The plaintiffs, husband and wife, brought this action against the defendant based on premises liability and negligence theories of recovery.
