Jeffrey Storm was an employee of Rite Aid Corp. from Aug. 20, 2001, through June 26, 2009. Storm was a loss prevention manager, but was fired in 2009.
Contentions
PLAINTIFF'S CONTENTIONS:
Storm contended he performed his duties well, was never disciplined, and always received positive performance reviews. However, he claimed that after he made an internal report about a manager falsifying documents to steal money, he was terminated. Rite Aid accused him of sending an inappropriate text message to the manager, which was a false grounds for firing him. Storm asserted causes of action for wrongful termination in violation of public policy, intentional infliction of emotional distress, breach of contract, and defamation.
DEFENDANT'S CONTENTIONS:
Rite Aid denied Storm's allegations, and asserted various affirmative defenses. They argued that he had failed to state a claim, failed to mitigate, was barred by the statute of limitations, and various other defenses.
Result
A jury awarded Storm $113,000.
