Facts

On April 20, 1994, plaintiff Justin Robinson, then a 9-year-old boy, hit his head on the playground at Mark Twain Elementary School during the morning recess at approximately 10:15 a.m. Plaintiff complained to the office secretary, his teacher and the health aide of a headache throughout the day. Plaintiff was in the school office and nurse's office on three separate occassions. The personnel of defendant Lawndale School District failed to take any action (i.e., call 911) until after plaintiff's mother arrived at school at 3:15 p.m. Paramedics were called at 3:23 p.m. The defendant school district disputed that plaintiff fell during the morning recess, complained about a headache throughout the day and disputed that it made a decision to call paramedics after the mother arrived. The plaintiff brought this action against defendant based on a negligence theory of recovery.
