On Sept. 29, 1994, plaintiff John Green, a 26-year-old computer installer, was driving eastbound in the outside lane heading toward the onramp to the 405 freeway. Defendant Sheldon Spector, M.D., rear ended plaintiff's vehicle. The plaintiff contended the defendant was negligent and that the accident caused injury to his back. According to plaintiff, defendant did not make a serious argument on liability. The defendant contended that plaintiff may have stopped suddenly and was, therefore, following too close to the vehicle in front of him at a speed which was unsafe for conditions. The plaintiff brought this action against defendant based on a negligence theory of recovery.
