Facts

On Feb. 9, 1996, plaintiff was travelling eastbound on Wilshire Boulevard in Los Angeles. He stopped at a red light at the intersection of Wilshire and La Brea and was rear-ended by defendant's vehicle. The plaintiff brought this action against defendant based on a negligence theory of recovery. The plaintiff contended defendant was not paying attention to the traffic, failed to stop and rear-ended him, causing his injuries. The defendant contended he stopped behind plaintiff's vehicle and, when he attempted to step on the brake, accidently hit the gas pedal.
