On Oct. 31, 1994, plaintiff Glenn Goldenberg, a manager for UPS, was traveling on 9th Avenue. The defendant, Elizabeth Silver was traveling westbound on Ortega Street. As the defendant crossed 9th Avenue, plaintiff's vehicle broadsided defendant's vehicle. The plaintiff brought this action against defendants based on a negligence theory of recovery.
