Plaintiffs brought a consolidated class action against Yapstone Holdings Inc., an online payments service provider, following a data breach in which the personally identifiable information of some of its users may have been exposed.
Contentions
PLAINTIFFS' CONTENTIONS:
Plaintiffs contended that defendant violated state consumer protection statutes, state data breach notification statutes and other state specific statutes. It was also negligent, committed breach of implied contract, and was unjustly enriched.
DEFENDANT'S CONTENTIONS:
Defendant contended that no personally identifiable information was extracted or misused.
Result
Pursuant to the settlement reached between the parties, eligible class members may receive 12 months of identity monitoring service from Experian at no charge.
