On December 29, 1992, Plaintiff, a 19-year-old student from Vancouver BC, was travelling with two other students through Santa Barbara on their way back to Canada. It was raining and late at night. The Plaintiff was pulled over to the side of U.S. 101 by a CHP officer for a violation. The CHP vehicle parked behind Plaintiff. An 18-wheel gasoline tanker/truck operated by the Defendant corporation inexplicably veered over the fog line, smashed into the CHP vehicle, which then was slammed violently into Plaintiff's vehicle. The CHP officer suffered serious injuries as well.
