Facts
Plaintiff Aurelio Morales, a 51-year-old truck driver, was driving his 3-ton bobtail truck when Defendant Tom MacGregor in the course and scope of his employment with Northrop Corporation struck Plaintiff's vehicle in a rear end collision. The incident happen in May 13, 1991. Plaintiff had prior hospitalization for low back injury in 1972, minor injury in September of 1990, and subsequent minor injury one week after the rear end collision while lifting a 100-pound bag at work.
