Facts

Plaintiffs Antonio and Mercina Vatakis closed and vacated their restaurant in April of 1992. Defendant Maritime Bank foreclosed on the real property in July of 1992. The bank allegedly sent out a Civil Code Section 1980 notice in October of 1992 and sold the property in December of the same year. Another Defendant, the property management company, was the only remaining Defendant at the time of trial.

Settlement Discussions

Defendant contends it made no offers and Plaintiffs demanded $225,000.

Damages

Fair market value of personal property, estimated value of $150,000 to $225,000; Plaintiffs also sought punitive damages.

Injuries

Plaintiff Antonio Vatakis claimed to have suffered heart failure as a result of Defendant's alleged conversion.

Other Information

The Court did not give Civil Code Sections 1953 and 1980 instructions to the jury.
