On December 31, 1991, Plaintiff Yolanda Hernandez, a 33-year-old dental assistant, was a passenger in a vehicle driven by Luis Lemus. This vehicle was struck in a rear end collision by a pick-up truck driven by Javier Ajun. The pick-up truck was in turn struck by Defendant Gustin's Cadillac. Prior to trial, Luis Lemus settled with Plaintiff for his $25,000 policy limits.
