On February 7, 1991, the plaintiff, Roszella Dawson, a 34-year-old retail clerk, sought treatment with the defendant, Mike K. Habib, M.D., for an undiagnosed illness. The defendant diagnosed the plaintiff with impetigo and treated her on multiple occassions from February 7, 1991 through July 20, 1993. The plaintiff was actually suffering from AIDS which the defendant failed to diagnose. The defendant also failed to refer the plaintiff to a specialist in either dermatology or infectious disease. The plaintiff brought this action against the defendant based on medical malpractice theories of recovery.
