In May of 1993, Albert Tlumac, a 69-year-old retired man, presented to the defendant, David Crnic, M.D., for a laproscopic cholecysectomy and umbilical hernia repair. The plaintiff was a diabetic with a history of gallbladder disease when he underwent the procedure without complication. Four months post-procedure, an abdominal hernia was detected by a subsequent treating physician. The plaintiff brought this action against the defendant based on medical malpractice theories of recovery.
