On April 10, 1994, the plaintiff, Jack Magnan, a 33-year-old unemployed man, was riding his motorcycle northbound at the intersection of Ventura and Santa Clara Streets in Ventura, California. He alleged that as he was slowing to make a left-hand turn onto Santa Clara Street, his motorcycle was struck from behind by a vehicle operated by the defendant, Karin Roberson. The plaintiff brought this action against the defendant based on negligence theories of recovery.
