Facts

On August 15, 1994, at approximately 6:15 a.m., the plaintiff a 28-year-old cement truck driver, was driving 1992 Mercury Sable northbound on 87th Street E in the defendant city. Defendant transit passenger bus, owned and maintained by the defendants, the transportation company and the city transit authority, and driven by the defendant bus driver, was traveling westbound on Avenue U. The passenger bus allegedly pulled out onto 87th Street E, in violation of the plaintiff's right of way, causing the plaintiff's vehicle to strike and become lodged underneath the passenger bus. The plaintiff brought this action against the defendants based on negligence theories of recovery.

The plaintiff alleged that she sustained bilateral mandibular fractures, a right proximal femur fracture, trauma to her right knee, TMJ bilateral, a possible tear of her medial meniscus, jaw joints whith popping, multiple facial lacerations and oral lacerations, causing severe scarring and resulting in her mental and emotional distress.
