On August 25, 1995, the plaintiff, an 18-year-old student/aspiring model, was on a church outing in Catalina Island. The plaintiff hitched a ride from the defendant driver, who was driving a golf cart. The plaintiff claimed the defendant's golf cart was overloaded and the defendant drove too fast, causing the golf cart to flip over. The defendant driver was uninsured. The plaintiff made this claim against the uninsured motorist carrier based on negligence theories of recovery.

Settlement Discussions

The plaintiff made a C.C.P. º998 settlement demand for $30,000. The defendant policy limits made a C.C.P. º998 offer of (policy limits) compromise for $30,000.
