On Oct. 15, 1994, the plaintiff, a 34-year-old correctional officer, was traveling through an intersection at approximately 45 mph. when her vehicle was struck by the defendant's vehicle, after the defendant ran a stop sign. The defendant stipulated to liability. The plaintiff brought this action against the defendant based on negligence theories of recovery.

Settlement Discussions

Pre-litigation, the defendant made a settlement offer of $8,700 and the plaintiff made a settlement demand for $15,000. After the lawsuit was filed, the plaintiff made a C.C.P. º998 settlement demand for $32,000 and the defendant responded with a C.C.P. º998 offer of compromise for $15,001.
