Facts

On July 16, 1994, the defendant tenant started a fire on rural property owned by the defendant landowner, which spread to consume several structures on the property. The plaintiffs' residential contents were temporarily stored in a barn that was consumed by the fire. The plaintiffs brought this action against the defendants, the landowner and the tenant, based on negligence theories of recovery.

Settlement Discussions

The plaintiffs made an initial settlement demand for $66,500. The defendant landowner made an initial settlement offer of $17,500.

Damages

The plaintiffs claimed $98,000 in damages for the residential contents stored in the barn on the defendant landowner's property.

Other Information

The settlement was reached approximately one year after the case was filed. The defendant landowner was insured. The defendant tenant was not insured and appeared in pro per.
