On Sept. 24, 1996, plaintiffs Cynthia, Spenser and Cashel Canada, were patrons at defendant Disneyland. When they were about to leave, the plaintiff mother, a 43-year-old homemaker, entered the Emporium store at approximately 9:30 p.m. The plaintiff mother had already purchased approximately $460 in Disneyland merchandise that day, but began to look at T-shirts. The plaintiff mother asked a merchandise hostess for an empty bag, and a security officer allegedly observed the plaintiff mother place the T-shirts in the bag and leave the store without paying. The plaintiffs were stopped outside the store and asked to return to the security office. Each minor plaintiff filed a claim for false imprisonment. The plaintiffs brought this action against the defendant based on false arrest, intentional infliction of emotional distress and negligent infliction of emotional distress theories of recovery.
