On April 18, 1995, plaintiff Jonathan Kaplan, a 36-year-old investment counselor, was driving on San Vicente Boulevard in Brentwood when his vehicle was rear-ended by a vehicle operated by defendant Victoria Havassy. The plaintiff brought this action against the defendant based on a negligence theory of recovery.
