Facts

On July 30, 1996, the plaintiff, a 55-year-old motel owner, was stopped at a stop sign when he was rear-ended by the defendant, an underinsured motorist. The plaintiff brought this action against the defendant based on a negligence theory of recovery. The plaintiff contended that the defendant violated California Vehicle Code º21703 (following too closely). The defendant's contentions were not disclosed.
