Facts

On Jan. 1, 1995, plaintiff Charles Malm, a 45-year-old husband and father, was staying with his wife and child at Motel 6 Disneyland. The plaintiff claimed that at 3 a.m., defendant's relief manager, Julie Morgan, and a security guard entered the plaintiff's room with a pass key and demanded that they leave the room. The plaintiff brought this action against the defendant based on trespass and emotional distress theories of recovery.

Settlement Discussions

The plaintiff made a settlement demand for $50,000. The defendant made an offer of compromise for $500.
