On June 2, 1999, the plaintiff, an egg donor, underwent an egg retrieval procedure, performed by
the defendant, a reproductive endocrinologist. The plaintiff had had three prior egg retrieval
procedures by other doctors. Post-operatively, the plaintiff experienced nausea, vomiting, light
headedness and fainting episodes, and reported these to Dr. Nelson in three phone calls the next
day; the last call lead to hospitalization in San Diego, where she lived. She was diagnosed as
having intra-abdominal hemorrhage, requiring three units of blood transfusion. A month later,
she required a laparoscopy for removal of a hematoma and adhesions. Subsequently, she
complained of chronic pelvic pain.

Plaintiff Albert Bucchi made C.C.P. Section 998 demand of $20,000; plaintiff Mandy Bucchi made a C.C.P. Section 998 demand of $65,000. The defendants offered a waiver of costs.
