Facts
The plaintiff had worked for defendant from 1995 until April 1998 when he was laid off due to a reduction in
force due to economic conditions. The plaintiff contended that the layoff was due to retaliation by his employer
for his refusing to engage in illegal acts. The plaintiff alleged that a former supervisor instructed plaintiff to use
a competitorÆs sensitive information in preparing briefing charts. The plaintiff refused to do so and was
subjected to retaliatory behavior by defendant.
The defendant alleged that the incident never took place; that plaintiff never reported the
incident to anyone in the company and the allegation was made for the first time in plaintiffÆs
complaint. In the past, plaintiff made prior allegations about defendantÆs improper motives for his
layoff, none of which had to do with alleged improper conduct by defendant.
Settlement Discussions
The plaintiff served a C.C.P. Section 998 offer of $2.8 million but it was withdrawn shortly thereafter. At mediation, the plaintiff demanded $6 million.
Injuries
The plaintiff sought $1.0 million in compensatory damages, unspecified emotional distress damages and punitive damages.
