Facts

The three plaintiffs were among seven individuals who were shot inside the lobby of a United Artists theater
located within the East Hills Mall in Bakersfield. They were shot while leaving the auditorium at the end of the
movie by a group of unidentified males wearing ski-masks. The gunmen, who were never captured, had begun
shooting at random into the crowd. The plaintiffs were taken by ambulance to a nearby hospital where they
were treated and eventually released.
