Facts

The plaintiff filed a complaint alleging that the Board of Podiatric Medicine required limited
licenses of podiatric residents who were participating in board-approved hospital and clinic
residencies after the expiration of the statutory authority for such licenses. The board
acknowledged that the fees were imposed and the licenses were issued without statutory
authority. After filing of the complaint, the court entered a preliminary injunction. The board
claimed to have fully complied with the terms of the preliminary injunction and had indicated
willingness to have a permanent injunction entered. The matter has not yet been set for trial.
