Facts

The plaintiff, Jay Firestone, loaned the defendant Peter Hoffman $375,000 for Hoffman's purchase of income investment property known as "The Princess of Monaco" in New Orleans, La. in June 1997. The parties entered into a written promissory note which, pursuant to its terms, was orally extended until demand was made by Firestone in November 2002. The defendant at that time claimed that the written promissory note was novated by a separate oral agreement that was designed to replace the written note. The plaintiff denied this contention and sought the principal under the written note plus interest and attorneys fees provided for in the note.
