On July 13, 2003, Rosa Aboytes, a 24-year-old garment worker, was shopping in downtown Los Angeles with her husband and son. As they crossed the street, the plaintiff was struck in the left leg with the edge of a hand truck being pushed by the son of an employee of the defendant Bonito Toys Inc. who was returning to the defendant's nearby wholesale toy outlet after transporting goods to a customer's vehicle.
Settlement Discussions
The defendant offered the amount of the medical specials shortly after the lawsuit was filed. The plaintiff demanded $100,000 at the mediation. The defendant increased its offer to C.C.P. Section 998 of $35,000.
