The plaintiff, Lori Senter, a 35-year-old data software quality control assurance employee with defendant TRW, was laid off with 150 other employees. The reason given to the plaintiff for her termination was that she was terminated due to financial reasons. The plaintiff was pregnant at the time. The plaintiff alleged that her employment was terminated because she was pregnant. At the time her employment was terminated, the plaintiff was earning approximately $50,000 per year. At the time of trial, the plaintiff was earning approximately $40,000 per year as a teacher. The defendant contended that the plaintiff's employment was terminated (she was laid off) for a legitimate business purpose, a cost reduction, and that the plaintiff was laid off along with approximately 150 other employees and, therefore, there was nothing the defendant should have done differently. The defendant further contended that although the plaintiff was eligible for rehire, she never reapplied.

Settlement Discussions

The plaintiff made a C.C.P. º998 demand for $135,000 and the defendant made a C.C.P. º998 offer of $50,000.
