Facts

On Jan. 18, 1996, the plaintiffs, a 54-year-old office worker and a 60-year-old longshoreman, were driving through an intersection when the defendant's vehicle made a left turn in front of their vehicle causing a head-on collision. The plaintiff longshoreman was taken by air to a medical center and underwent immediate surgery. The plaintiff office worker was taken by ambulance to the hospital where she received treatment and was released. The plaintiffs brought this action against the defendant based on negligence. Per plaintiffs, the defendant agreed that he operated his vehicle negligently and that the plaintiff suffered injuries as a result; but disputed the extent of damages claimed.

Settlement Discussions

The plaintiffs made a settlement demand for $240,000. The defendant made an offer of $233,825.41.

Injuries

The plaintiff longshoreman suffered a diaphragmatic rupture with intrusion of the stomach into the thorax, a grade-3 splenic laceration and several facial lacerations. The plaintiff office worker suffered bilateral air bag burns, a left chest contusion, a rib and fibular fracture; and soft tissue injuries to the right knee and lumbosacral area.

Other Information

The settlement was reached approximately six months after the case was filed.
