On March 15, 1996, the plaintiff, a 32-year-old unemployed woman, was at the defendant's restaurant and bar in Bellingham, WA, when she was stuck in the head by a glass allegedly thrown by the individual defendant. The plaintiff was talking to the individual defendant's boyfriend at the time who was also the on-duty bartender at the lounge. The plaintiff settled with the bar owner and brough this action against the individual defendant based on assault. The plaintiff contended the defendant assaulted her by hitting her in the head with the glass. The defendant contended the bar glass slipped out of her hand while gesturing to her boyfriend. The witnesses in the bar testified that defendant was loud and cursing prior to the glass being thrown.
