On Sept. 3, 1993, plaintiff Blaine Johnson, an 18-year-old mechanic, was driving on Carney Lake Road. An uninsured motorist passed the plaintiff on a corner, striking the plaintiff's vehicle. The plaintiff lost control and left the roadway, eventually hitting a tree. The plaintiff brought this action against the defendant under the uninsured motorist policy.

The plaintiff claimed 90 percent permanent loss of sense of smell, broken nose, broken rib, fractured teeth and a concussion. He also suffered headaches, soft tissue injuries to the neck, back and knee; and scars on the nose and chin.
