Facts

On Jan. 26, 1995, the plaintiff, a 38-year-old account clerk, was traveling westbound on the Pomona Freeway at approximately 55 mph in the No. 4 lane. The defendant, driving approximately 55 mph in the No. 3 lane, attempted to change to the No. 4 lane, colliding with the plaintiff. The high speed impact caused the plaintiff's vehicle to be pushed over the side of the freeway and down an embankment, where she crashed head-on into a tree. The plaintiff brought this action against the defendants based on negligence.
