On June 30, 1996, plaintiff Jesus Lopez, a 52-year-old laundry maid, was walking with her daughter, plaintiff Judy Marin, age 10, on the sidewalk in front of defendant Thomas Caverly's 10-unit apartment complex in Santa Ana. She slipped and fell on water and mud in front of the premises on the public sidewalk, fracturing her ankle. The plaintiffs brought this action against the defendants based on negligence and premises liability theories of recovery.
